Rulings on DACA and More

CAL THOMAS COMMENTARY MARCH 7, 2018

THERE WERE TWO SIGNIFICANT RULINGS BY FEDERAL

JUDGES ON MONDAY. JUDGE ROGER TITUS RULED THAT PRESIDENT TRUMP’S PHASEOUT OF THE OBAMA-ERA DACA PROGRAM IS LEGAL. THE RULING DOES NOT OVERTURN TWO OTHER FEDERAL COURTS, WHICH HAD PREVIOUSLY BLOCKED THE PHASEOUT, WHICH WAS SUPPOSED TO TAKE EFFECT ON MONDAY, BUT IT DOES OFFFER A BOOST AS THE JUSTICE DEPARTMENT APPEALS THOSE OTHER TWO RULINGS.

ANOTHER FEDERAL JUDGE RULED THE TRUMP ADMINISTRATION WILL NOT HAVE TO IMMEDIATELY AWARD CALIFORNIA A GRANT IT HAS WITHHELD OVER CONCERNS THE STATE IS A SANCTUARY FOR PEOPLE IN THE COUNTRY ILLEGALLY. WHILE THE AMOUNT OF MONEY IS SMALL – ONLY $1 MILLION – AND IS ONLY DELAYED FOR THE MOMENT, NOT DENIED, JUDGE WILLIAM ORRICK REJECTED CALIFORNIA’S REQUEST FOR A PRELIMINARY INJUNCTION TO TURN OVER THE MONEY. HE ALSO REJECTED A DEPARTMENT OF JUSTICE REQUEST TO DISMISS THE STATE’S LAWSUIT, SAYING HE NEEDS TO HEAR MORE ARGUMENTS FROM BIOTH SIDES.

THESE TWO RULINGS BEAR WATCHING BECAUSE EACH COULD HAVE A SIGNIFICANT IMPACT ON ILLEGAL IMMIGRATION AND SANCTUARY CITIES AND STATES. I’M CAL THOMAS IN WASHINGTON.
