CAL THOMAS COMMENTARY NOVEMBER 20, 2018
EDUCATION SECRETARY BETSY DEVOS HAS DONE SOMETHING SO LOGICAL ONLY THE LEFT WOULD OPPOSE HER AND OF COURSE, THEY DO.
HER DEPARTMENT’S CIVIL RIGHTS OFFICE HAS FORMALLY PROPOSED A NEW REGULATION, WHICH WOULD CREATE A MORE JUST PROCESS WHEN CAMPUS TRIBUNALS ADJUDICATE SEXUAL MISCONDUCT CASES. UNTIL NOW, MANY UNIVERSITIES ALLOWED FOR KANGAROO-STYLE COURTS THAT BASICALLY TOOK THE ACCUSER AT HER WORD WITH NO OPPORTUNITY FOR THE ACCUSED TO CROSS EXAMINE. THIS OFTEN RESULTED IN PENALTIES, INCLUDING EXPULSION FROM A SPORTS TEAM, LOSS OF SCHOLARSHIPS, EVEN EXPULSION.
THE OBAMA ADMINISTRATION HAD STRONGLY DISCOURAGED SCHOOLS FROM CROSS-EXAMINATION OF AN ACCUSER. AS THE WALL STREET JOURNAL NOTED, THE OBAMA POLICY WAS A PRESUMPTION OF GUILT.
THE PROPOSED REGULATION WOULD APPLY NATIONALLY. CROSS-EXAMINATION IS THE BEST WAY TO GET AT THE TRUTH AS ANYONE WHO HAS EVER WATCHED PERRY MASON OR OTHER SUCH SHOWS KNOWS FULL WELL. GOOD FOR BETSY DEVOS AND HER STAFF. THIS IS A LONG OVERDUE REGULATION. IT WILL PROTECT MEN WHO HAVE BEEN FALSELY ACCUSED OF SEXUAL MISCONDUCT. I’M CAL THOMAS.
