ARIZONA AND ABORTION

CAL THOMAS COMMENTARY APRIL 11, 2024

THE SUPREME COURT OF ARIZONA HAS UPHELD A LAW FROM THE CIVIL WAR ERA THAT BANS ABORTIONS FROM THE MOMENT OF CONCEPTION WITH THE EXCEPTION OF SAVING THE LIFE OF THE MOTHER.

THE RULING ALLOWS THE 160-YEAR-OLD LAW TO STAND. IT MAKES ABORTION PUNISHABLE BY TWO TO FIVE YEARS IN PRISON FOR ANYONE WHO PERFORMS ONE, OR HELPS A WOMAN TO OBTAIN ONE.  THE LAW WAS CODIFIED IN 1901 AND AGAIN IN 1913.

THE LAW WAS ENACTED FIFTY YEARS BEFORE ARIZONA BECAME A STATE AND WAS NEVER REPEALED. AN APPELATE COURT LAST YEAR RULED THE LAW COULD REMAIN ON THE BOOKS AS LONG AS IT “HARMONIZED” WITH A 2022 LAW. THIS HAS LED TO CONFUSION IN ARIZONA REGARDING EXACTLY WHEN DURING PREGNANCY ABORTION IS OUTLAWED.

IT WON’T BE CONFUSING TO THE LEFT WHICH IS GOING TO USE THE LAW AS A WEAPON IN THEIR FIGHT TO RETAIN THE WHITE HOUSE, THE SENATE AND POSSIBLY A HOUSE MAJORITY.

THAT THE LAW WAS PASSED 160 YEARS AGO AND WE NOW HAVE ABORTION ON DEMAND IN MANY STATES SHOWS YOU THE MORAL SLIDE THAT HAS INFECTED AMERICA ON SO MANY LEVELS. I’M CAL THOMAS.
