DUE PROCESS FOR ALL, OR NONE

CAL THOMAS COMMENTARY MARCH 19, 2025

UNDER THE CONSTITUTION, “DUE PROCESS” MEANS THAT EVERY AMERICAN IS SUPPOSED TO BE TREATED EQUALLY AND FAIRLY AND IF CHARGED WITH A CRIME, HAVE THE OPPORTUNITY TO DEFEND ONE’S SELF IN COURT.

NO ONE IS LAMENTING THE DEPORTATION OF THOSE VENEZUELAN CRIMINAL GANG MEMBERS FROM THE U.S. TO EL SALVADOR. A FEDERAL JUDGE IN SAN FRANCISCO ORDERED THE DEPORTATION BE PUT ON HOLD UNTIL DUE PROCESS COULD BE AFFORDED THEM. THE ADMINISTRATION HAS IGNORED THE JUDGE’S ORDER.

YES, JOE BIDEN IGNORED A SUPREME COURT DECISION THAT SAID HE COULDN’T UNILATERALLY FORGIVE STUDENT LOANS. BUT THAT ISN’T A JUSTIFICATION FOR IGNORING DUE PROCESS IN THE CASE OF THE VENEZUELAN GANG MEMBERS. YES, THEY ARE VERY BAD PEOPLE, BUT THAT DOESN’T CANCEL DUE PROCESS.

THEY COULD HAVE BEEN SENT TO GUANTANAMO WHERE IMMIGRATION JUDGES WOULD HEAR THE CASES AGAINST THEM. IF FOUND TO BE DEPORTABLE THEY COULD THEN BE DEPORTED.

THINK OF IT THIS WAY. IF YOU WERE ACCUSED OF CRIME, WOULD YOU DEMAND DUE PROCESS, OR WOULD YOU BE OK WITH THE GOVERNMENT DENYING YOU THAT CONSTITUTIONAL PRIVILEGE IN PURSUIT OF ITS OBJECTIVE. IF DUE PROCESS DOESN’T WORK FOR ALL, IT WORKS FOR NONE. I’M CAL THOMAS.
